There should be a spear unit called Auxiliary Infantry or somesuch available from the Auxilia barracks. They don't match up to triarii, but they can do the job.
After settling things in Italy, my first port of call with the Romans is Crete, to set up a max level Aux barracks there; Hoplites, good peltasts (Better than velite) and amazing archers. In my opinion, a Greco-Roman mixed force is better than pure Roman; you just take the best of both.
i just checked my recruitment in Rome, where i have the max level Aux barracks, it offers zero spear units, also the unit you mention, ain't mentioned on the wiki for the building, checked all 3 levels
i guess i have run into some kind of bug, and its sadly gamebreaking since im still unable to do battles, the auto resolve kills off even my best armies if i go up against a horse heavy enemy, since i can only field swords, bah....
i also have the racetrack in Rome, which, according to the wiki, should allow for gladiator spearmen, i don't have those either....so it certainly looks like a bug

I have the same problem too, no Triarii even after aux building maxed out, I get other spear unit but very subpar comapred to triarii
The triarii will disappear from your game after you research the military reforms. It's a shame to lose such a good unit, but the ones you unlock make up for it.
EDIT: Plus, there's nothing stopping you from recruiting a bunch of them before the reforms, and simply not upgrading them afterwards. As long as you keep them alive, you should be able to hold onto them indefinitely.

Weird that they're not showing up for you, Drenus; they should be available at every aux barracks, regardless of location.

If you look in your in-game encyclopedia, go into units and then look at Rome's units, scroll down to Auxiliary units, and on each unit's page there will be a 'Requires' section to the right, which will display what level of building they need, as well as which locations.

i am trying....really hard, to enjoy this game, despite no acces to the battle part of the game, and other bugs, and the game just keeps giving me the finger....
oh well, patch broke my savegames just now, so it doesn't matter anymore

I'm really sorry you're encountering so much crap with your game, amigo. Whilst it's running okay on mine (And I've been really enjoying it), even I'm contemplating shelving it for a month or so and coming back when they've had some time to throw some meaningful patches at it.
All I can suggest is for you to do the same, to save yourself the stress this will undoubtedly be causing you, and before it annoys you to the point where you'll never touch it again
There's an amazing diamond in this game, I'm sure of it, but it needs a hell of a polish.
Also, if you haven't already, you could try verifying the files, just in case a patch hasn't installed properly or has messed something up. Chances are it won't work, but it might be worth a try just in case.

i tried verifying cache, and now it insist on downloading the entire game again
its almost like somebody went to great lenght to ensure that i would never get to enjoy this game....
and yea, i agree, there's a diamond hidden in this game, its just a shame it was released in such a rough state , Empire held the throne for most buggy release, but im starting to think Rome 2 has surpassed it
