It can't pass. It conflicts with Fair Use, after all.
You'd think so but look how fierce it got in the Blizzard Entertainment vs KeSPA case in terms of copyright infringement and broadcasting StarCraft in terms of OSL, MSL, MST, and ProLeague. The only thing that was keeping Blizzard from collecting fines awarded by the church was the Ministry of Culture (Korean government office) while the US office saw it as fair grounds.
Blizzard Entertainment only caved (and didn't do an injunction during the trial process) was because they knew they would lose a massive chunk of customers in South Korea as well as a good handful internationally.
